<p>資深媒體人、《政經關不了》節目主持人彭文正因揭發總統蔡英文論文門醜聞遭到通緝，他的委任辯護律師張靜昨（21日）一早驚傳住處和事務所，遭台東檢警持搜索票依涉妨害祕密與《個資保護法》進行搜查，張靜在被送上偵查車前直言這是典型的查水表、政治追殺，他被警方帶回偵訊後，當晚即移送地檢署徹夜複訊，檢方今（22）凌晨2時向法院聲請羈押，法院稍早宣判於法有悖，聲押駁回！</p>

<p><a href="https://udn.com/news/story/7321/6181891" target="_blank" rel="noreferrer noopener">根據《聯合報》報導</a>，台東檢警昨持搜索票，搜索媒體人彭文正的律師張靜住家、事務所等處，帶回部分證物，張靜也被帶回警訊，晚間送台東地檢署複訊，檢方詢問張到今天凌晨2點。台東地檢署表示，檢察官偵訊後認定，張涉妨害秘密、個人資料保護法罪嫌重大，本案尚有證人未到案，張無固定住所，且與相關證人都認識，有勾串證人之虞，向法院聲請羈押。</p>

<p>台東地方法院刑事第一庭法官蔡政晏在審理後，認為檢察官未經以「被告」身份傳喚，而認聲請人（張靜）無正當理由不到場，而拘提之，實難認本案檢察官核發拘票符合法定之程序。綜上，本件核發拘票之合法性既有疑義，則員警持拘票拘提聲請人，其拘提之合法性即有疑義。綜上所述，本件執行機關所為拘提程序，經核其程序既於法有悖，是本件聲請人之聲請為有理由，聲請人應予釋放。</p>
